LuluCare Terms of Service

Welcome to LuluCare! These Terms of Service ("Terms" or "Agreement") constitute a legally binding agreement between you (hereinafter referred to as "User" or "you") and LuluCare ("we," "us," or "our"). By accessing or using any feature or service of LuluCare, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree with any part of these Terms, please discontinue using the app immediately.

1. Eligibility and Age Restrictions

1.1 Minimum Age Requirement

Unless otherwise required by applicable laws, you must be at least 13 years of age (or such other minimum age under your local law at which you can legally consent to data processing) to use this app, and you must not use it in any manner that is prohibited by applicable law.

1.2 Users Aged 13 to the Age of Majority

If you are 13 or older but still a minor in your jurisdiction, you represent and warrant that your parent or legal guardian has reviewed and accepted these Terms on your behalf, and that your parent or legal guardian is responsible for your actions while using LuluCare, whether or not they have provided prior authorization for your actions.

1.3 Organizations and Entities

If you are agreeing to these Terms on behalf of an organization or entity, you represent and warrant that you are authorized to bind that organization or entity to these Terms. In that case, references to "you" in these Terms (except in this sentence) refer to the organization or entity.

1.4 Geographical Scope

LuluCare is available worldwide. If your country/region enforces stricter regulations on minimum age, data processing, or other aspects of service usage, you must comply with such local legal requirements. Otherwise, please stop using our services.

2. Nature of Services and Disclaimer

2.1 Self-Help Mental Support

LuluCare uses artificial intelligence algorithms to provide self-help mental support, emotional management, and educational resources to users. We do not offer medical diagnoses or professional mental health treatment; the information within LuluCare is intended for general educational and reference purposes only.

2.2 No Emergency or Crisis Intervention

LuluCare cannot provide emergency medical services, crisis intervention, or suicide prevention support. If you or someone else experiences an emergency situation (such as suicidal intentions, risk of harm to others, or other life-threatening circumstances), please immediately call your local emergency telephone number or seek professional medical help. LuluCare is not liable for handling such emergencies.

2.3 No Patient-Provider Relationship

All content provided by LuluCare (including text, suggestions, dialogues, etc.) does not constitute medical or psychological advice, and using LuluCare does not establish any form of physician-patient or therapist-client relationship between you and LuluCare. If you have any concerns regarding your physical or mental health, please consult a professional doctor or a certified mental health professional in a timely manner.

3. Subscription, Payments, and Refunds

3.1 Weekly Subscription

LuluCare currently offers weekly subscriptions. You may select a subscription plan within the app. The subscription fee will be automatically charged on a weekly basis to the payment method you have linked (e.g., App Store or another payment account).

3.2 Auto-Renewal

  • Your subscription will automatically renew 24 hours before the current billing cycle ends unless you disable auto-renewal at least 24 hours before the cycle ends through your App Store or other applicable account settings.
  • The renewal fee will be the same as your initial subscription unless we have changed the subscription price; in that case, we will provide prior notice within the app.

3.3 Canceling the Subscription

  • You can manage or cancel your subscription at any time through the App Store (or other relevant app store).
  • If you cancel, you will continue to have access to the paid features until the end of your current billing period, after which you will lose access to such features.

3.4 Refund Policy

  • Subscription fees are generally non-refundable unless otherwise required by law. If you believe you need a refund under exceptional circumstances, please follow the relevant app store's refund procedure (e.g., Apple App Store) and contact their customer support. We will cooperate with the app store's official process.
  • If the app store denies your refund request, we are not obligated to provide additional refunds, to the extent permitted by law.
  • If local laws mandate broader refund or cancellation rights, such consumer protection laws shall take precedence.

4. User Conduct

4.1 Lawful Use

You agree to use LuluCare solely for lawful and proper purposes and not to engage in any illegal, infringing, or harmful activities via this app.

4.2 Account Security

  • You are responsible for maintaining the confidentiality of your username and password. Any actions taken through your account are considered your own.
  • If you discover your account has been compromised or suspect any security risk, please contact us immediately at LuluCareteam@gmail.com.

4.3 Accuracy of Personal Information

We only collect your age, nickname, and gender to improve our services. You must ensure that all information you provide is accurate, complete, and not misleading. LuluCare is not liable for any consequences arising from inaccurate or false information provided by you.

5. Privacy and Cross-Border Data Transfers

5.1 Privacy Policy

We place great importance on protecting your personal data and privacy. Please carefully review our Privacy Policy, which is incorporated into these Terms by reference. If your country/region has special requirements concerning cross-border data transfers or data storage (e.g., GDPR), we will make reasonable efforts to comply and take the necessary measures.

5.2 Data Deletion and Account Closure

If you wish to delete your personal information or close your account, please follow the procedure outlined in our Privacy Policy or email us at LuluCareteam@gmail.com. We will address your request within a reasonable timeframe. However, you acknowledge that certain data may be retained as required by law or compliance requirements.

6. Intellectual Property

6.1 Rights of LuluCare

Unless otherwise specified or lawfully licensed, LuluCare retains all copyrights, trademarks, and other intellectual property rights in this app (including the software, UI design, AI dialogue logic, and textual content). Without our explicit written permission, you may not copy, resell, distribute, modify, or create derivative works based on our app in any form.

6.2 User-Provided Information

Unless otherwise stipulated by law, any personal information or content you upload or provide remains yours. LuluCare does not claim ownership over such information. By using LuluCare, however, you consent to our reasonable, lawful use and processing of the provided information where necessary to deliver our services, subject to our Privacy Policy.

7. Limitation of Liability

7.1 As-Is Basis

LuluCare and its content are provided on an "as-is" basis. We do not guarantee their accuracy, completeness, consistency, or suitability, nor guarantee uninterrupted usage or error-free operation.

7.2 Disclaimer of Warranties

To the maximum extent permitted by applicable law, we make no express or implied warranties, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

7.3 Scope of Liability and Exceptions

  • To the extent permitted by law, LuluCare is not liable for indirect, incidental, special, or consequential damages (including lost profits or data) resulting from your use of, or inability to use, our services. For direct damages, our cumulative liability shall be limited to the total subscription fees you paid to us for the most recent billing period.
  • If applicable law does not allow exclusion or limitation of certain liabilities (e.g., liabilities arising from willful misconduct, gross negligence, personal injury, etc.), we will abide by the relevant legal requirements.
  • If any provision in these Terms conflicts with mandatory local laws, the mandatory local laws take precedence.

8. Governing Law and Dispute Resolution

8.1 Governing Law

These Terms and any dispute arising from or related to them or the use of LuluCare shall be governed by the laws of the People's Republic of China, unless otherwise mandated by the mandatory laws of your jurisdiction. Such mandatory laws shall prevail in the event of a conflict, but this does not affect the remaining provisions of these Terms.

8.2 Cross-Border Disputes and Venue

If a dispute arises between you and LuluCare concerning these Terms or the use of our services, the parties shall first attempt to resolve it amicably. If negotiations fail, legal action or arbitration may be initiated in accordance with the procedures of either your country/region or the jurisdiction where LuluCare is registered. In the absence of other agreements, any dispute may be brought before the competent court or arbitration body in LuluCare's place of registration.

9. Modifications and Notices

9.1 Right to Modify

We may update these Terms from time to time due to business needs or legal requirements. If a material change is made, we will notify you through in-app push notifications or other reasonable channels. The updated Terms will indicate the effective date.

9.2 Your Choice

If you continue using LuluCare after the updated Terms become effective, you will be deemed to have accepted the new Terms. If you do not agree with the revised Terms, you may discontinue using LuluCare and request to close your account.
